Rising Son Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a legal agreement between you and Reclaimed Heart LLC, doing business as Rising Son ("Rising Son," "we," "us," or "our"). They govern your access to and use of our website, programs, community, events, and services (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent that you are 18 or older and able to enter into a binding agreement.

3. What Rising Son is, and what it is not

Rising Son provides coaching, education, and peer support for men. Our coaches may hold advanced degrees and professional training, including clinical training. Within Rising Son, they provide coaching services only.

The Services are not therapy, counseling, psychotherapy, or mental health treatment. They are not a substitute for professional medical, psychological, psychiatric, or other licensed care. Using the Services does not create a therapist-client, clinician-patient, or doctor-patient relationship. We do not diagnose, treat, or cure any medical or mental health condition.

The Services are not a crisis or emergency service. If you are experiencing a medical or mental health emergency, or you are thinking about harming yourself or others, call 911 (or your local emergency number) or go to the nearest emergency room. In the United States, you can also call or text 988 to reach the Suicide and Crisis Lifeline.

You are responsible for your own decisions and actions. You should consult a qualified professional for any medical or mental health concern.

4. No guaranteed outcomes

Our programs are designed to support your growth, but personal change depends on many factors, including your own effort and circumstances. We do not promise or guarantee any specific result, outcome, or improvement in your relationships, wellbeing, or life.

5. Accounts and community conduct

To use parts of the Services, you may need to create an account or profile. You are responsible for keeping your login information secure and for activity under your account.

Our community is a shared space. You agree to treat other members with respect and to follow any community guidelines we provide. You agree not to harass, threaten, or abuse others, post unlawful or harmful content, or disrupt the community. We may remove content or suspend or remove members who violate these Terms or our guidelines.

You also agree to respect the privacy of other members. What is shared within the community and in groups is meant to stay within the community. Our Confidentiality page explains this, and its limits, in more detail.

6. Payment, billing, and cancellation

Fees for our programs, memberships, and events are described to you before you purchase or enroll. Payments are processed by our third-party payment processor, Stripe. By enrolling, you authorize us to charge the applicable fees to your chosen payment method, including any recurring fees for a membership until you cancel.

You may cancel your membership by following the cancellation instructions provided to you at signup or by contacting us at connect@risingson.org. Cancellation stops future billing. Fees already paid are handled according to the refund terms provided to you at the time of purchase.

7. Events and retreats

We may offer in-person and virtual events, including retreats. Additional terms, fees, and requirements may apply to events, and you may be required to sign a separate release, waiver, or participation agreement before attending.

At our events, we may capture photos, audio, and video. By attending, you agree that we may record the event and, subject to any separate release you sign, use those recordings as described in our Privacy Policy.

8. Testimonials and feedback

If you provide a testimonial, review, or feedback, you grant us permission to use it to promote and improve our Services, unless you tell us otherwise in writing. We may edit testimonials for length or clarity without changing their meaning.

9. Recording and AI tools

Our community calls and webinars may be recorded. Coaching group and individual sessions are not recorded, but calls may be transcribed and summarized using AI-powered tools to support the coaching relationship. By participating, you consent to this. See our Privacy Policy and Confidentiality page for more.

10. Intellectual property

The Services, including our content, materials, curriculum, text, graphics, logos, and branding, are owned by Reclaimed Heart LLC or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to access and use our content for your own personal, non-commercial use as part of the Services. You may not copy, share, sell, or redistribute our content without our written permission.

11. Your content

You keep ownership of the content you post in our community and share with us. By posting or sharing content through the Services, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and use that content as needed to operate and provide the Services. You are responsible for the content you share and represent that you have the right to share it.

12. Confidentiality

Confidentiality within Rising Son, including within the coaching relationship and the community, and the limits and exceptions that apply to it, is described on our Confidentiality page, which is part of these Terms.

13. Third-party services

The Services rely on third-party tools and platforms, and may link to third-party websites. We are not responsible for third-party services or content, and your use of them may be subject to their own terms.

14. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

15. Limitation of liability

To the fullest extent permitted by law, Reclaimed Heart LLC and its owners, employees, coaches, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

16. Indemnification

You agree to indemnify and hold harmless Reclaimed Heart LLC and its owners, employees, coaches, and contractors from any claims, damages, losses, and expenses, including reasonable attorney fees, arising out of your use of the Services, your content, or your violation of these Terms.

17. Termination

We may suspend or end your access to the Services at any time if you violate these Terms or our guidelines, or to protect the Services or others. You may stop using the Services at any time, subject to the payment and cancellation terms in Section 6.

18. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be handled in the state or federal courts located in Utah, and you consent to their jurisdiction, unless applicable law requires otherwise.

19. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after an update means you accept the revised Terms.
